Quick Reference Guide 9: Need to-know Facts to Work as RN in the US Under NAFTA

Set aside politics and harness the opportunities from the warmer regions of the South. Three important things you need to do or have: Must pass the NCLEX-RN, a Canadian Passport and an RN job offer.

Prerequisites:
  • Must pass the NCLEX-RN (for Canadian RN/US RN jurisdictions)
  • Must be Canadian citizen to be eligible to work in the States under the North American Free Trade Agreement or the NAFTA
  • Must have a job offer from a US employer*
  • Must be RN in the jurisdiction of employment
*US employers MAY require most recent bedside RN experience.

(1) If you passed the NCLEX-RN for Canadian RN jurisdictions, submit an application to the State Board of Nursing. Refer to Quick Reference Guide 7: Reciprocity from Canadian RN to US RN Practise. If you became Canadian RN through the Canadian Registered Nurse Examination (CRNE) or the Ordre des Infirmières et Infirmiers du Québec Professional RN Exam (Québec Provincial RN Exam), submit an application for licensure by examination to a State Board of Nursing and pass the NCLEX-RN.

(2) Confirm that you are hired and given a job offer for an RN position from a US employer. Be wary of recruiters who may take advantage of you. 

(3) Some US State Boards of Nursing require credential verification processes. It would be wise to choose CGFNS among other accredited third-party credential verification service providers. A non-US educated RN must complete the CGFNS VisaScreen to obtain a VisaScreen Certificate required for immigration processes.

CGFNS may accept the documents you submit to them for another CGFNS service. Like for example, an NCLEX-RN passer Canadian RN intends to submit a reciprocity/endorsement application to a certain State BON that requires a credential evaluation/verification service prior to issuance of RN license. If this applicant purchases a CGFNS credential evaluation/verification service for reciprocity or endorment purposes, the applicant MAY not be required by CGFNS to resubmit the same documents needed for the CGFNS VisaScreen.

(4) A TN employer (hiring employer) may file on behalf of the Canadian citizen (the prospective employee) by submitting Form I-129 Petition a Non-Immigrant Worker to the United States Citizenship and Immigration Services (USCIS).

(5) Three things you need to have prior to admittance to any US Port of Entry:
  • Supporting documentation (VisaScreen Certificate, job offer etc)
  • Proof of Canadian Citizenship
  • Approval Notice from USCIS Form I-129

The Agreement on Internal Trade Chapter 7 lawfully allows Canadian-licensed nurses to practice nursing across Canada including Québec and the Territories.
